MyCare Home Health Services, LLC offers care to all individuals regardless of race, color, religion, gender, sexual orientation, gender identity or expression, age, national origin, disability, genetic information, marital status, or any other characteristics.
By accessing or using the services provided by MyCare Home Health Services LLC ("Company," "we," or "our"), you agree to the following Terms of Service. Please read them carefully before engaging with our services. If you do not agree to these terms, you must refrain from using our services.
1. Scope of Services
MyCare Home Health Services LLC provides personalized home health care services, including but not limited to personal assistance, memory care, and respite care. The specific services to be provided will be outlined in a care plan agreed upon by the client and the Company.
2. Service Agreement
Prior to the commencement of services, a Service Agreement will be executed between the client (or their authorized representative) and the Company. This agreement will outline:
The scope of services provided.
The frequency and duration of services.
Associated costs and payment terms.
3. Client Responsibilities (condensed)
To ensure effective care, the client (or their authorized representative) agrees to:
Provide accurate and complete information regarding health conditions, care needs, and preferences.
Maintain a safe and accessible environment for the caregiver or nurse to perform their duties.
Notify the Company promptly of any changes in health status or care needs.
4. Payment Terms
Payment for services is due in accordance with the terms outlined in the Service Agreement.
Late payments may incur additional fees, as detailed in the Service Agreement.
The Company reserves the right to suspend or terminate services for non-payment.
5. Cancellation and Termination
Either party may cancel services with a minimum of 7 days notice.
The Company may terminate services immediately if:
There is a breach of the Service Agreement.
The environment is deemed unsafe for our staff.
There is non-payment for services.
6. Employee Insurance and Liability
All caregivers and nurses employed by MyCare Home Health Services LLC are insured. The Company assumes responsibility for its staff while they perform duties as outlined in the Service Agreement. However, the Company is not liable for any damages caused by third parties or unforeseen events outside its control.
7. Privacy and Confidentiality
The Company is committed to protecting client information in compliance with applicable laws, including HIPAA. All personal and medical information will be kept confidential and used solely for the purpose of delivering care.
8. Limitations of Liability
While MyCare Home Health Services LLC strives to provide the highest quality care, we are not responsible for:
Medical complications or emergencies arising from pre-existing conditions.
Services provided by third-party vendors or individuals not employed by the Company.
Events or circumstances beyond the Company’s control (e.g., natural disasters).
9. Modifications to Terms
The Company reserves the right to update or modify these Terms of Service at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the updated terms.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Massachusetts, U.S.A. Any disputes arising from these terms shall be resolved in the courts of Massachusetts, U.S.A.
